Indiana Sales Tax Exemption Information for FCUs
Federal credit unions (FCUs) are exempt from Indiana’s Sale Tax and for many years have used the Indiana Dept. of Revenue’s ST-105 (General Sales Tax Exemption Form) to obtain the exemption when making purchases with vendors and service providers. At the end of 2023, the Dept. of Revenue made a change in the use of the ST-105 form for nonprofit organizations requiring them to instead use a NP-1 form, which has led to questions from FCUs as to whether that change impacts them. In short, the change for nonprofit organizations does not impact FCUs and FCUs should continue to utilize the ST-105 form to obtain exemption from Indiana Sales Tax.
FCUs are exempt from Indiana Sales Tax not because they are nonprofit organizations but rather because they are considered to be instrumentalities of the federal government, which is exempt from sales taxes. While nonprofit organizations are now required obtain and use the NP-1 form, FCUs should continue to use the ST-105 form, which is attached. The League confirmed this with the Dept. of Revenue and received the following instructions:
Federal credit unions should continue to use the ST-105 form. On Section 4 where it asks the purchaser to indicate the type of exemption being claimed, the credit union should check the box that says Sales to the United States Government and list the credit union name where it asks for the agency name.
