It is becoming more common for people to use assisted reproduction to build their families, and as a result more people have frozen stored sperm, eggs and embryos at a fertility clinic. Unlike other things a person may own, the federal Assisted Human Reproduction Act creates a unique mandatory regime for the use of stored reproductive material. Provincial law also has specific provisions for legal parentage of children born through assisted reproduction, both those born during a person's life and potentially after their death. In this seminar you will learn about:
- How the federal Assisted Human Reproduction Act and its regulations affect the use of reproductive material at death;
- The modern parentage framework for assisted reproduction under the Children's Law Reform Act as amended by the All Families are Equal Act;
- The interaction of family law with estates law, including requirements for recognizing posthumously conceived children for inheritance purposes;
- Leading cases in Ontario and relevant cases in other provinces; and
- Practical tips and examples that are likely to arise in practice.
