From Request to Resolution: Reducing Risk in Employee Leave and Accommodation Decisions - A Practical Guide for In-House Counsel
Employee requests for leave or workplace modifications can trigger overlapping obligations under the ADA, the FMLA, the Pregnant Workers Fairness Act, and state and local laws governing accommodations. This session will provide in-house counsel with a practical framework for identifying accommodation and leave requests, guiding the interactive process, evaluating potential accommodations, and documenting defensible decisions. Through real-world examples, the presentation will also address mitigating retaliation risks and common mistakes that can increase litigation exposure.
Speaker: Lily McNulty, Shareholder
