Matt Gray and Christy Dunn, attorneys with Young Moore and Henderson, P.A., will explore tools and best practices that supervisors, managers, and human resource professionals can employ to try to avoid terminations in the first place, and to navigate necessary terminations on solid footing.

After this session, attendees should be able to:

  • Identify circumstances that lead to termination (such as failure to meet expectations, violation of company policies, and miscommunication that leads to breakdown in work relationships).
  • Identify strategies for helping employees overcome these circumstances and reverse course to avoid termination (including critical conversations and performance improvement plans).
  • Define the elements of unlawful retaliation and wrongful discharge.
  • Learn essential practices when termination is imminent, such as critical recordkeeping, careful evaluation of all circumstances that could be construed as unlawful bases for termination, consideration of whether company policies are being enforced equally, and effective communication among relevant constituents.
  • Be mindful of various termination scenarios and get prepared to handle them gracefully and with integrity, clear communication, and support for the departing employee.
