AI in Protective Order: Lessons from Cerebras and Schulte
AI-related provisions are becoming increasingly common in protective orders and ESI protocols, but recent decisions from the Northern District of California demonstrate that not all AI restrictions are created equal. In one case, the parties voluntarily agreed to disclose AI prompts, validation methodology, and review metrics. In another, the court refused to compel many of those same disclosures.
