Regulator Session: EP Act 2017 Waste and Contaminated Land Framework - Interactions and FAQs

Under the EP Act 2017, which came into effect on 1 July 2021, there are duties associated with contaminated land and the waste framework which aim to reduce the risk of harm to human health and the environment from pollution and waste.At times these duties may interact and function concurrently. This webinar will explore the interaction between the contaminated land and waste frameworks with a particular focus on soil, looking at some common scenarios where this may occur, and considerations to apply when evaluating which duties apply. It will also address some of the frequently asked questions that are commonly arising across the industry, on aspects such as waste categorisation, reuse of soil, when does soil become a waste, and more.

Dru assisted in the policy development and drafting of Victoria’s new Environment Protection Act and its supporting regulations. As part of EPA Victoria’s (EPA) transformation division advised on implementation of the new Act and has been a key author on policy and guidance development on the new contaminated land scheme. He now manages EPA’s new internal review unit that considers review requests of remedial notices issued under the new Act.

Mark Bannister is the Manager of Waste and Contaminated Land Policy at EPA leading a team of highly-skilled policy professionals with expertise in waste and contaminated land. In partnership with the Department of Environment, Water, Land and Planning, Mark and the waste and land team designed and delivered the regulatory framework for waste underpinning the new Environment Protection Act. The new framework reflects engagement with industry and community across 100 events, 300 submissions and thousands of participants in online webinars and forums. Before joining the policy unit, Mark has had several roles in EPA including data analytics, intelligence and air quality working with the CSIRO on future air quality modelling.

Mark and Dru will be supported by other EPA personnel in answering questions.
