EVENT: The North Face Hike on Vashon Island

DATE OF EVENT: June 13, 2026

PLEASE REVIEW THE TERMS AND CONDITIONS OF THIS WAIVER AND RELEASE OF LIABILITY (“WAIVER”) CAREFULLY. THIS WAIVER IS A 

CONTRACT BETWEEN YOU AND The North Face, A DIVISION OF VF OUTDOOR, LLC, AND ITS PARENT, AFFILIATES, SUBSIDIARIES, 

EMPLOYEES AND AGENTS (TOGETHER, “VF”) AND GOVERNS YOUR PARTICIPATION IN THE ABOVE EVENT AND ANY OTHER ACTIVITIES THAT 

TAKE PLACE AT THE ABOVE EVENT (“EVENT”). IF YOU AGREE TO BE BOUND BY THIS WAIVER, SIGN THIS WAIVER. IF YOU DO NOT AGREE, 

THEN DO NOT SIGN, AND YOU WILL NOT AND CANNOT PARTICIPATE IN THE EVENT. THIS WAIVER INCLUDES YOUR EXPRESS GRANT OF RIGHTS 

TO USE YOUR NAME AND IMAGE.

1. In exchange for being permitted to participate in the Event, I hereby agree to assume all risks associated with my participation in the 

Event and to release, hold harmless, discharge VF and all affiliated organizations, individuals and entities, designated, sponsors, first-aid 

volunteers, officials, participants, technicians, any persons in any restricted area, participating communities, organizations, and all of 

their respective parents, subsidiaries, officers, directors, agents, employees and members (collectively, “Event Partners”) from any and 

all liability. I hereby waive my rights with respect to all claims I may have with respect to and/or against VF and any of the Event Partners 

for damages for death, personal injury or property damage, including medical bills, lost wages, pain and suffering, loss of consortium, 

emotional distress, attorneys’ fees and court costs, which I may have, or which may hereafter accrue to me as a result of my participation 

in the Event, even though this liability may arise through no fault of my own, or from the negligence or carelessness on the part of the 

persons or entities being released. Except with respect to liability that is prohibited from being disclaimed under the law, each of VF and 

the Event Partners hereby disclaims all liability and warranties for the Event.

2. I AM AWARE AND UNDERSTAND THAT PARTICIPATING IN THE EVENT MAY BE DANGEROUS AND INVOLVE THE RISK OF SERIOUS INJURY, 

DEATH, OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY BE COMPOUNDED BY NEGLIGENT 

EMERGENCY RESPONSE OR RESCUE OPERATIONS OF VF AND/OR THE EVENT PARTNERS. I ACKNOWLEDGE THAT I AM VOLUNTARILY 

PARTICIPATING IN THE EVENT WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ALL RISKS 

OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF VF, THE EVENT PARTNERS, OR OTHERWISE.

3. I hereby grant VF and the Event Partners the rights to display, publicly perform, transmit, broadcast, reproduce, record, photograph, 

modify, adapt, create derivative works of, sublicense, or otherwise use and publish my image, name, likeness, voice, and any statements 

made by me, whether in oral or transcribed form, in any media format worldwide (the “Images”) for its and their marketing and 

promotional purposes in connection with the Event in perpetuity (“Image Release”). I represent, warrant, and covenant that the Image 

Release is and will be without compensation to me or any third party. I hereby irrevocably release VF and the Event Partners and waive 

(on behalf of myself and my heirs, assigns and any other party) any claim of any kind or nature whatsoever arising from VF and/or the 

Event Partners’ use of the Images as described herein. I agree that I will not now or in the future assert or maintain any of such claims 

against VF and/or the Event Partners. I acknowledge and agree that I have no right to approve VF’s and/or the Event Partners’ use of the 

Images and no right to any compensation, consideration or accounting, and I will not make any claims for compensation against VF, the 

Event Partners, or any other party. In addition, I acknowledge full and sole responsibility for my own medical expenses, and I am 

responsible for any and all medical expenses incurred on my behalf. If I should become injured while participating in the Event, I authorize 

VF or any of the Event Partners to secure medical assistance on my behalf and at my expense.

4. If any one or more of the provisions contained in this Waiver is held to be invalid, void, illegal or unenforceable in any respect, such 

invalidity, voidness, illegality or unenforceability will not affect any other provision of this Waiver, and the remaining portions will remain 

in full force. This Agreement is separate from any engagement or other duties and responsibilities I have with VF in any other capacity. 

5. I further declare that I am at least 18 years old and legally competent to sign this Waiver, or I have acquired the written consent of my 

parent or legal guardian. I understand that these terms are legally binding, and I have signed this document of my own free will. I further 

represent that I have the legal power and authority to sign this Waiver and to grant the license and rights set forth herein and that the 

consent of no other person or entity is required to authorize the use described herein. 

BY SIGNING THIS WAIVER, I HEREBY EXEMPT AND RELEASE VF AND EACH OF THE EVENT PARTNERS FROM ALL LIABILITY OR RESPONSIBILITY 

WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH OR ANY OTHER CAUSE OF ACTION, HOWEVER CAUSED, 

INCLUDING NEGLIGENCE, WHETHER PASSIVE OR ACTIVE. I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF 

THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP AND/OR GRANTING SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO 

SUE VF AND/OR THE EVENT PARTNERS AND THE RIGHT FOR VF AND/OR THE EVENT PARTNERS TO USE MY IMAGE AND LIKENESS
