"Planning and Conducting Workplace Investigations
Presented by Cozen O'Connor
Workplace investigations require in-house counsel to balance speed, fairness, confidentiality, and legal risk at every stage. This program will provide a practical framework for planning and conducting effective, defensible investigations, from determining the appropriate scope and selecting the right investigator and team to implementing interim measures and conducting neutral, well-structured interviews. The discussion will address strategies for protecting confidentiality and privilege, preventing retaliation, and preserving, collecting, and evaluating evidence from a wide range of sources. The program will also explore how to document findings and communicate outcomes in a clear and defensible manner, while navigating remedies, fairness and inclusion considerations, cross-border privacy requirements, and the responsible use of AI-assisted tools in the investigation process.
