PROGRAM DESCRIPTION

This CLE explores how in-house counsel can respond when new and unexpected litigation emerges – and how insurance can help fund the defense and protect against resulting liability.  First, using COVID-era tuition-refund class actions as a case study, the program will examine how plaintiffs transform unexpected events into novel theories of liability, how those theories evolve into new claims, and how in-house counsel can anticipate and manage emerging claims.  Second, the program will use the resulting insurance coverage disputes to illustrate how in-house counsel can identify and pursue insurance when novel claims arise, including by evaluating defense-cost and indemnity coverage, exclusions, self-insured retentions, and statute-of-limitations issues. Together, these case studies provide a practical framework for responding to emerging litigation while maximizing the value of existing insurance programs.

Please plan to arrive by 2:50 p.m. The Chapter will host its annual meeting of members for the purpose of electing 2027 Officers and Directors.

Following the program, you are invited to join us for a networking reception.
