COMMUNICABLE DISEASES
Exposure to communicable diseases/viruses is an inherent risk in any public location where people are present. Some diseases are more contagious than others and can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and those with underlying medical conditions are especially vulnerable. Benchmark Medical Services, LLC, its agents, members, contractors, suppliers, and guests cannot guarantee you will not be exposed during or as a result of participating in the on-site courses we provide. Therefore, by participating in an in-person class and any events, classes, or courses that may be related to one of our in-person classes, you voluntarily assume all risks related to exposure to any communicable disease/virus to which you may become exposed and, therefore, permanently hold harmless Benchmark, its volunteers, employees, agents, representatives, members, contractors, suppliers, and guests from all claims, demands, and causes of action which you or any respective heirs, executors, administrators, or assigns have or may have resulted in your voluntary participation.
COURSE COMPLETION
Benchmark courses are an all-or-none completion. The following must be completed to be considered for course completion:
-One-Hundred percent (100%) physical presence and 100% active participation in every aspect of the activity and, if applicable, in any additional, optional course(s) for which the participant may register, and
-Successful completion and timely submission of all pre-course assignments for the refresher course and, if applicable, in any additional, optional courses(s) for which the participant may have registered, and
-Completion and submission of any post-activity evaluations and surveys, and
-Successful completion and submission of online and, in some cases, paper, post-course examinations that may be applicable for the additional, optional course(s) for which the participant may have registered.
Completion is defined as the participant successfully demonstrated the core knowledge on the said date, and Benchmark, its faculty, staff, assistants, and agents neither implicitly nor explicitly guarantee any degree of future performance. Therefore, by participating in this activity, the participant hereby indemnifies and holds harmless Benchmark, its faculty, staff, assistants, and agents from any claims that may arise from participation in this activity or activities. The participant furthermore agrees and understands that comprehension and future performance is an individual responsibility; that Benchmark does not license or certify individuals in skills or procedures; and that the participant must adhere to their local standing orders, protocols, or other medical direction, and within the individual's scope of practice.
COURSE COMPLETION DOCUMENTATION REPLACEMENT POLICY
Post-course documentation is emailed to the email address of record, usually within 30 days from course completion. Post-course documentation is presumed to have been received unless returned. A replacement fee of $25.00 per document will be assessed for any reason other than an error on our part.
AHA DISCLAIMER
The American Heart Association (AHA) strongly promotes knowledge and proficiency in BLS, ACLS, and PALS and has developed instructional materials for this purpose. Using these materials in an educational course does not represent course sponsorship by the American Heart Association. Any fees charged for such a course, except for a portion of fees needed for AHA course materials, do not represent income to the Association.
PRIVACY NOTICE
Submission of information will be retained for course attendance, participation, and reporting as may be required by the course sponsor and or distributor of continuing medical education certificates. This information may be used to notify the participant of future continuing education or training opportunities. Benchmark makes reasonable attempts to protect participant personal information submitted against public inspection and disclosure absent a subpoena or for health oversight activities as described herein.

REFUNDS & CANCELLATIONS
No refunds for on-site or Virtual Instructor Live Training (VILT) classes will be considered after course registration has closed or if the request is received within ten days of the course start date.
Registration fees minus a fifty percent (50%) cancellation fee will be assessed for Benchmark-approved cancellation requests.
There are no refunds for CVENT registration or credit card processing fees.
There are no refunds for AHA online accessed courses or manuals/books.
Benchmark reserves the right to implement policy on a case-by-case basis for circumstances not addressed herein.
CAPCE ACCREDITED COURSES
By participating in an activity approved by Benchmark Medical Services, LLC, an organization accredited by the Commission on Accreditation for Pre-Hospital Continuing Education (CAPCE), 1) I understand that CAPCE is the national accrediting body charged with the review and accreditation of EMS continuing education (CE), and 2) I understand and agree that my course completion records may be accessed by or shared with such regulators as state EMS offices, training officers, and NREMT on a password-protected need-to-know basis, and 3) I further understand that I may review my record of CAPCE-accredited course completions by contacting CAPCE.
NEW CAPCE ATTENDANCE VERIFICATION REQUIREMENTS
The accredited organization (Benchmark) must establish a mechanism for reliably verifying participant attendance for the time allotted to each topic or session. The CE provider (Benchmark) must develop a method that will document the participant's identity, time spent in the activity, test items and scores, if applicable, and a summary of the participants' evaluations of the effectiveness of the activity. The method must also meet the requirements of the state and professional organizations to which participants must report their CE. THEREFORE, be advised and prepared, that by completing the registration process and participating in this activity, you affirm that you understand Benchmark, at its sole discretion, may require you to submit your driver's license or other appropriate and applicable government-issued photo identification and or other means determined by and acceptable to Benchmark for verification purposes of participant identity, participation, entry, or re-entry, and that you agree to cooperatively comply with such requests when made by a Benchmark Medical Services, LLC official representative.
PHOTOGRAPH AND VIDEO RELEASE
Considering my participation in this activity for which I am registering, I hereby grant permission to the rights of my image, likeness, and sound of my voice as recorded on audio or video without payment or any other compensation. I understand that my image may be edited, copied, exhibited, published, or distributed, and I waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to using my image or recording. I also understand that this material may be used in diverse educational settings within an unrestricted geographical area with or without my name, including for marketing purposes or any other lawful purpose, any publication and any medium, including, by way of example and not limitation, posting a photo of me from the activity on a social media web site, (collectively, "Reproduction") without further consideration. I assign to Benchmark all right, titles, and interests in and to all such reproductions as well as the unencumbered right to exercise such rights in all media and by any means now known or hereafter created, throughout the world, in perpetuity. I hereby hold harmless and release and forever discharge Benchmark, its volunteers, employees, agents, representatives, and licensees, from all claims, demands, and causes of action which I or any respective heirs, executors, administrators, or assigns have or may have resulted because of this Photograph and Video Release.

By submitting registration information and participating in the registered course(s), you, the registrant/participant, hereafter referred to as "you" or "your," attest that you have read, understand, and agree with the course disclaimers, terms, submission agreement, conditions, and notices and that you have submitted to the best of your knowledge correct and true information. Benchmark does not guarantee implicitly or explicitly comprehension or future performance. You understand that learning, comprehension, and functioning at your level of license or certification and adhering to the Standard of Care, Scope/Duty of Care, and Scope of Practice is an individual responsibility; thereby, you agree to hold harmless Benchmark, its agents, employees, and instructors from any and all personal and professional liability and expense including attorney's fees and costs arising from, or as a result of, your negligence. You acknowledge that it is your responsibility to notify Benchmark immediately via email of any change in the information used for registration to help ensure proper and timely notification and or receipt of course information or documentation.
