The new administration is prioritizing worksite enforcement and targeting employers with increased ICE activity. This presentation will discuss how employers can prepare and protect themselves.  

  • Potential ICE visits: We will discuss employers’ legal rights and obligations in CA under AB 450 and how to prepare for a visit from ICE.  
  • Potential ICE Audits: We will discuss how ICE determines and imposes monetary fines and criminal penalties for I-9 violations, and recommendations on how employers can prepare for an ICE audit to minimize fine and liability exposure. We will also discuss the additional fines and potential criminal charges an employer could face by continuing to employ individuals who are not legally authorized to work. 
  • Potential Hard Choices & Tough Conversations: We will talk about the importance of discussing a plan with the company’s ownership and management as to how the company will address and handle employees who may no longer be authorized to work and not eligible for relief – to be ready for some potentially difficult choices that may be needed.

Danielle Gotcher practicing law since 2005, and has practiced exclusively in immigration law since 2012, with expertise in corporate and employment-based immigration matters. Before joining GIP, Danielle’s practice focused on litigation, defending large retail chains, partnerships, insurance companies, employers, and professionals against liability claims. With her litigation background, she has a unique perspective and experience in guiding employers and business owners on liability and compliance matters, as well as experience negotiating with ICE and other government agencies on behalf of her clients.

A graduate of Boston University, she received a Bachelor’s degree in Political Science and a Bachelor’s degree in Communications, both awarded Magna cum Laude. Prior to law school, Danielle was selected to work in the White House, serving in the Office of Communications and Press.

She earned her law degree from Southwestern University in Los Angeles and is admitted to practice law in the State of California and the Central District of California. Danielle has been invited to speak at numerous HR professional conferences and has been selected as an expert for panels and seminars at attorney conferences and continuing education courses.

Danielle was born and raised in Southern California, and she lives in Thousand Oaks, CA with her husband (and business partner) and their daughter.
