This panel discussion brings together three experienced estate and tax practitioners to address the legal and tax complexities that arise when Canadian estates intersect with foreign jurisdictions, assets, and beneficiaries. Drawing on real fact patterns, the panelists will provide practical guidance on issues including:
- Non-resident personal representatives: bonding requirements, provincial residency restrictions, and the practical challenges of administering a Canadian estate from abroad
- Non-resident beneficiaries, including minors: withholding obligations on distributions, clearance certificate timing, and structuring distributions where no recognized local guardianship exists
- Foreign assets held by Canadian estates: ancillary probate, civil law forced heirship rules, the role of notaries in estate administration, and jurisdiction-specific considerations for European situs property
- Cross-border tax and filing obligations: US estate tax exposure, treaty relief, and information reporting requirements, and Canadian withholdings and reporting for distributions to non-resident beneficiaries
Attendees will leave with concrete tools for identifying issues early, coordinating with foreign counsel, and avoiding common compliance pitfalls in multi-jurisdictional estate matters.
